§ 394.361 — Official Map

Plain-Language Summary

This section allows counties to adopt official maps that show where land will be needed for future streets, highways, airports, and other public facilities. Once a map is adopted, the county does not have to pay for buildings built without a permit in mapped areas. The board of adjustment can override a permit denial if the owner cannot use the property otherwise.

Practical Notes
Adopting an official map does not give the county ownership of the mapped land. However, if you build without a permit in a mapped area, the county does not have to compensate you for that building when it acquires the land. If a building permit is denied, the board of adjustment can allow it if justice requires, but the county then has six months to start acquiring the land.
