§ 394.26 — Public Hearings

This section requires public hearings before a county can approve or deny conditional use permits, variances, interim use permits, or subdivision proposals. Notice must be published in a newspaper at least ten days before the hearing. Written notice must also be sent to nearby property owners.

Practical Notes
In unincorporated areas, the notice distance depends on the type of application: 500 feet for variances, one-quarter mile for conditional uses, and one-half mile for other controls like zoning changes. Affected town boards and nearby municipal councils within two miles must also receive written notice.
