§ 453.53 — Municipal Power Agencies; Incorporation

Plain-Language Summary

Two or more cities or existing municipal power agencies can create a new municipal power agency by signing an agency agreement. Each city's governing body must pass a resolution to authorize the agreement. The agency becomes a separate government body when the agreement is filed with the Secretary of State.

Practical Notes
If your city wants to join a municipal power agency, the city council must pass a resolution and sign the agency agreement. The agency is governed by a board of directors with members from each participating city. Cities can join or leave the agency as allowed by the agreement.
