2025 Session Last amended: 2011 session

§ 466.07 — Indemnification

Plain-Language Summary

Requires municipalities to defend and indemnify their officers and employees against tort claims, provided the employee was acting in the performance of duties and was not guilty of malfeasance, willful neglect, or bad faith.

Practical Notes
If you are a municipal employee sued for actions taken during your job duties, your employer must provide your legal defense and pay any judgment, as long as you acted in good faith. This applies to all school districts.
