2025 Session Last amended: 2002 session

§ 513.60 — Waiver

Plain-Language Summary

The seller and buyer can agree in writing to waive the seller disclosure requirement. However, waiving this disclosure does not waive or limit any other disclosure obligations created by other laws.

Practical Notes
Buyers and sellers can agree to skip the formal seller disclosure if they both sign a written waiver. This is sometimes done in as-is sales. However, this waiver only covers the requirements under sections 513.52 to 513.60 and does not excuse the seller from other legal obligations to disclose, such as lead paint or radon disclosures.
