§ 514.981 — Medical Assistance Lien

Plain-Language Summary

This section creates a lien in favor of the state on the real property of medical assistance recipients for the cost of their institutional care. The lien attaches after notice and a hearing opportunity, and only when the recipient is not expected to return home. The lien cannot be filed while the recipient's spouse lives in the home.

Practical Notes
If you receive medical assistance while in a nursing home and are not expected to go home, the state can place a lien on your real property. The state must give you notice and an opportunity for a hearing first. Your spouse’s home is protected while they live in it.
