§ 524.3-803 — Limitations on Presentation of Claims

Plain-Language Summary

This section sets the deadlines for creditors to file claims against an estate in Minnesota. Creditors who receive published notice have four months to file. Creditors who receive direct mail notice get the later of four months or one month after service. All claims must be filed within one year of death, except for Medical Assistance recovery claims.

Practical Notes
When this applies: Whenever someone wants to collect a debt from a deceased person’s estate. Who this affects: Creditors, personal representatives, and heirs. Key points: If you are owed money by someone who died, you must file your claim within four months of the published notice or one year of death, whichever comes first. Missing the deadline usually means losing the right to collect. Medical Assistance claims are not subject to the one-year deadline. Claims based on mortgages and liens are not affected by these deadlines. Claims covered by liability insurance can still be pursued up to the insurance limits.
