2025 Session Last amended: 1915 session

§ 541.09 — Action to Be Commenced Within One Year

Plain-Language Summary

Lawsuits based on a judgment note or any document that allows a confession of judgment must be filed within 1 year. Lawsuits on judgments entered by confession in any court must also be filed within 1 year of the judgment.

Practical Notes
A ‘confession of judgment’ is when a debtor agrees in advance to let a creditor get a judgment without a trial. Minnesota law gives these judgments only a 1-year enforcement window, much shorter than the 10-year window for regular judgments. This reflects the state’s strong policy against confessions of judgment.
