§ 541.15 — Periods of Disability Not Counted

Plain-Language Summary

The statute of limitations clock pauses if the person who wants to sue is under 18, mentally incapacitated, a citizen of a country at war with the U.S., or if a court order or law prevents them from filing. For minors, the clock does not start until they turn 18. For medical malpractice claims against minors, the pause lasts up to 7 years.

Practical Notes
This is especially important for children who are injured. A child’s right to sue does not expire until after they turn 18, regardless of when the injury happened. For adults with disabilities like mental incapacity, the extra time is capped at 5 years beyond the normal deadline, or 1 year after the disability ends, whichever comes first.
