§ 571.71 — Garnishment; When Authorized

Plain-Language Summary

Lists the three situations when a creditor can garnish your wages, bank account, or other property: before judgment with a court order, after you fail to respond to a lawsuit for 45+ days, or after a money judgment is entered against you.

Practical Notes
If you have been served with a summons and complaint, responding within 45 days is critical to prevent garnishment without a judgment. Even after default, the creditor must send a Notice of Intent to Garnish and wait 20 more days before garnishing.
