This is one of the most important sections for debtors. You must receive an exemption notice before garnishment. If a creditor ignores your valid exemption claim in bad faith, you can recover damages, attorney fees, and a penalty up to $100. Conversely, filing a bad-faith exemption claim carries the same penalties. The garnishee can only hold up to 110% of the unpaid claim.
