§ 571.75 — Garnishee Disclosure

Plain-Language Summary

Contains the required disclosure forms that employers and banks must complete when served with a garnishment summons. Includes the Earnings Disclosure Form (with a worksheet for calculating withholdings), the Child Support Earnings Disclosure Form, and the Non-Earnings Disclosure Form for bank accounts and other property.

Practical Notes
Employers must complete the Earnings Disclosure Worksheet for each payday within the 90-day garnishment period and return it to the creditor. If you are a debtor, you are entitled to receive a copy of the disclosure and can request information about how the calculations were made. Garnishees must disclose within 20 days (or 10 days after the last payday for earnings).
