§ 571.79 — Discharge of a Garnishee

Plain-Language Summary

Explains when a garnishee is released from the obligation to hold a debtor's property. Key time limits: 180 days after service if the garnishment was after judgment, or 270 days if before judgment. If these periods expire, the garnishee must return the property to the debtor.

Practical Notes
This is important for debtors whose funds have been held for a long time. If the creditor does not act within the 180-day or 270-day window, the garnishee must release your funds. A creditor can challenge a discharge by filing a motion within 20 days of the disclosure or property return.
