§ 580.042 — Foreclosure Advice Notice to Tenant

Plain-Language Summary

When a rental property with one to four units is being foreclosed, the lender must send tenants a special notice explaining their rights. The notice tells tenants that the foreclosure does not change their lease, they must keep paying rent, and they cannot be forced to move during the redemption period unless they violate their lease.

Practical Notes
Tenants should know that a foreclosure does not automatically end their lease. They still have rights, and the new owner must give written notice before asking tenants to move. Failure to send this notice does not cancel the foreclosure, but the lender can be fined $500.
