2025 Session Last amended: 1990 session

§ 604.01 — Comparative Fault; Effect

Plain-Language Summary

In Minnesota, if you are partly at fault for an accident, you can still recover money for your injuries -- but only if your fault is not greater than the other person's fault. Your payment will be reduced by your share of the blame. For example, if you are 30% at fault and your damages are $10,000, you would receive $7,000.

Practical Notes
Important for anyone involved in a personal injury, property damage, or wrongful death case where the injured person may share some of the blame.
