2025 Session Last amended: 1990 session

§ 340A.801 — Civil Actions

Plain-Language Summary

Minnesota's dram shop law. Allows injured persons — including spouses, children, parents, and employers — to sue a liquor vendor who illegally sold alcohol to the person who caused their injuries. Comparative fault applies, and insurance subrogation claims against liquor vendors are barred.

Practical Notes
This is the primary statute for dram shop liability claims in Minnesota. Claimants must also comply with the notice requirements in section 340A.802. Subdivision 6 preserves common-law claims against adults who furnish alcohol to persons under 21.
