§ 609.104 — Fine and Surcharge Collection

Governs the collection of unpaid fines, surcharges, court costs, restitution, and fees. If a defendant misses a payment, the entire remaining balance becomes due and the case can be sent to collections. Defendants can contest the referral to collections by requesting a hearing.

Practical Notes
You must be notified in writing at sentencing that your case may be sent to collections if you do not pay, and that collection costs may be added. You have the right to request a hearing based on inability to pay. A victim’s right to collect restitution through civil judgment is not affected by these time limits.
