§ 609.12 — Parole or Discharge

Governs parole and discharge for prisoners sentenced to a term less than life. The Supervised Release Board can grant parole at any time if it would help rehabilitation and serve the public interest. For sentences over 5 years where the maximum is 10 years, parole must generally be granted after 5 years minus good behavior credit.

Practical Notes
The Supervised Release Board has broad discretion over parole decisions. Parole conditions are set by the board. For longer sentences, the board can deny required parole only if it finds the defendant’s release would not help rehabilitation or would harm public safety.
