§ 609.195 — Murder in the Third Degree

Plain-Language Summary

Defines third-degree murder in Minnesota. Covers two situations: (1) causing death by an act that is eminently dangerous to others and shows a depraved mind, without intent to kill (e.g., firing a gun into a crowd), and (2) causing death by unlawfully selling or distributing Schedule I or II controlled substances. Punishable by up to 25 years in prison.

Practical Notes
Third-degree murder does not require intent to kill a specific person. The ‘depraved mind’ standard means engaging in extremely reckless conduct showing complete disregard for human life. This charge is also commonly used when someone dies from drugs that were illegally sold or given to them. A conviction carries up to 25 years in prison and/or a $40,000 fine. Seek legal counsel immediately if facing this charge.
