§ 609.2247 — Domestic Assault by Strangulation

Plain-Language Summary

Makes it a felony to assault a family or household member by strangulation. Strangulation means intentionally blocking someone's breathing or blood flow by pressing on their throat or neck, or blocking their nose or mouth. The penalty is up to 3 years in prison and a $5,000 fine.

Practical Notes
This is a standalone felony charge separate from general domestic assault. Family or household members include spouses, former spouses, parents, children, people living together, and people who have a child together. Strangulation in a domestic setting is treated as especially dangerous regardless of visible injury.
