§ 609.233 — Criminal Neglect

It is a crime for a caregiver or facility operator to intentionally neglect a vulnerable adult or knowingly allow conditions that lead to abuse or neglect. Basic neglect is a gross misdemeanor. Intentionally depriving a vulnerable adult of food, clothing, shelter, or health care is a felony, with penalties up to 10 years in prison if it causes great bodily harm.

Practical Notes
This law holds caregivers and facility operators responsible for providing basic needs to vulnerable adults in their care. Employees who lack authority over staffing or policies may have a defense if inadequate staffing caused the neglect. The law does not override a vulnerable adult’s right to refuse medical treatment or choose spiritual healing.
