§ 609.2664 — Manslaughter of Unborn Child in the First Degree

Plain-Language Summary

First-degree manslaughter of an unborn child means intentionally causing the death of an unborn child in the heat of passion, or causing the death while committing a misdemeanor or gross misdemeanor where death was foreseeable. It also covers acting under coercion. The penalty is up to 15 years in prison, a fine up to $30,000, or both.

Practical Notes
This charge is less serious than murder because it involves situations where the killing was provoked, occurred during a less serious crime, or was done under threat. The ‘heat of passion’ defense requires that the provocation would have affected a reasonable person. The pregnant woman herself cannot be charged under this law.
