§ 609.322 — Solicitation, Inducement, and Promotion of Prostitution; Sex Trafficking

Plain-Language Summary

Sex trafficking is a serious felony in Minnesota. First-degree sex trafficking involves minors under 18 and carries up to 25 years in prison, or up to 30 years with aggravating factors. Second-degree sex trafficking involves adult victims and carries up to 20 years. Mandatory minimum prison sentences apply, and the law includes presumptive sentences of 77 to 172 months.

Practical Notes
This is one of Minnesota’s toughest criminal statutes. It targets pimps, traffickers, and anyone who profits from prostitution, not the prostitutes or patrons themselves. The mandatory minimum sentences mean most convicted offenders will serve prison time. Cases from multiple counties within a six-month period can be combined into one prosecution.
