§ 609.33 — Disorderly House

Plain-Language Summary

It is a gross misdemeanor to own, operate, or maintain a 'disorderly house,' which is a place where illegal liquor sales, gambling, prostitution, or drug dealing regularly occur. Mandatory fines range from $300 for a first offense to $1,000 for a third offense. Evidence of these illegal activities in a building is enough to establish the building is a disorderly house.

Practical Notes
This law targets property owners and operators, not just the individuals committing crimes inside. Landlords can be charged if illegal activity regularly occurs in their properties. As a condition of bail, a court can require the property owner to evict tenants involved in drug activity. Local governments can impose even stricter rules.
