§ 609.342 — Criminal Sexual Conduct in the First Degree

Plain-Language Summary

Defines criminal sexual conduct in the first degree, the most serious sex offense in Minnesota. Covers sexual penetration accomplished through force, threats of harm, use of a weapon, injury to the victim, or with a person who is mentally impaired or physically helpless. Also covers sexual penetration of minors under age 16 in various circumstances. Punishable by up to 30 years in prison, with mandatory minimum sentences for repeat offenders.

Practical Notes
First-degree criminal sexual conduct (CSC) is among the most severely punished crimes in Minnesota. Sentencing guidelines presume prison time even for first offenses, and repeat offenders face mandatory minimum sentences. A conviction requires lifetime registration as a predatory offender. Separate subdivisions address adult victims and child victims under various age thresholds. Anyone accused of this crime should immediately consult with a criminal defense attorney and should not speak to police or investigators without counsel present.
