§ 609.343 — Criminal Sexual Conduct in the Second Degree

Plain-Language Summary

Defines criminal sexual conduct in the second degree. Covers sexual contact (touching, not penetration) accomplished through force, threats, weapons, or with a person who is mentally impaired or physically helpless. Also covers sexual contact with minors under age 16 in various circumstances. Punishable by up to 25 years in prison.

Practical Notes
Second-degree CSC involves sexual contact rather than penetration but is still a very serious felony. ‘Sexual contact’ includes intentional touching of intimate parts for sexual purposes. Like first-degree CSC, a conviction requires lifetime registration as a predatory offender and sentencing guidelines presume incarceration. Separate subdivisions address adult and child victims. Consult a criminal defense attorney immediately if accused.
