§ 609.345 — Criminal Sexual Conduct in the Fourth Degree

Plain-Language Summary

Defines criminal sexual conduct in the fourth degree. Covers sexual contact (touching, not penetration) accomplished through coercion, force, or with a person who is mentally impaired, mentally incapacitated, or physically helpless. Also applies to actors in prohibited occupational relationships and certain situations involving minors. Punishable by up to 10 years in prison.

Practical Notes
Fourth-degree CSC is a felony carrying up to 10 years in prison and/or a $20,000 fine. It parallels third-degree CSC but involves sexual contact rather than penetration. It covers abuse-of-authority situations (therapists, clergy, corrections employees, etc.) involving sexual touching. A conviction requires predatory offender registration. Consult a criminal defense attorney immediately if you are accused of or charged with this offense.
