§ 609.351 — Applicability to Past and Present Prosecutions

The criminal sexual conduct laws that took effect on August 1, 1975, do not apply to crimes committed before that date, except for the evidence rules in section 609.347. Crimes committed before that date are governed by the laws in effect when the crime occurred.

Practical Notes
This is a transitional provision from when Minnesota updated its sexual assault laws in 1975. It ensures that the new laws are not applied retroactively to older cases. The evidence rules in section 609.347 are the exception and do apply even to pre-1975 prosecutions.
