§ 609.352 — Solicitation of Children to Engage in Sexual Conduct; Communication of Sexually Explicit Materials to Children

It is a felony for anyone 18 or older to ask a child (15 or younger) to engage in sexual conduct, or to use the internet, phone, or other electronic devices to solicit a child for sex, discuss sexual conduct with a child, or send sexual material to a child. The penalty is up to five years in prison, a fine up to $10,000, or both.

Practical Notes
This law covers online predators who use the internet, social media, text messages, or other electronic means to contact children for sexual purposes. Mistake about the child’s age is not a defense. Police sting operations where an officer poses as a child are specifically allowed. The law applies if the communication is sent from or received in Minnesota.
