§ 609.365 — Incest
Plain-Language Summary
Incest means having sexual intercourse with a close blood relative, including parents, children, siblings, grandparents, grandchildren, aunts, uncles, nieces, and nephews. The person must know about the relationship. It is a felony punishable by up to 10 years in prison.
609.365 INCEST.
Whoever has sexual intercourse with another nearer of kin to the actor than first cousin, computed by rules of the civil law, whether of the half or the whole blood, with knowledge of the relationship, is guilty of incest and may be sentenced to imprisonment for not more than ten years.

Practical Notes
This law applies to relatives closer than first cousins, whether related by half blood or whole blood. The relationship is calculated using civil law rules. Knowledge of the family relationship is required for a conviction. This is a separate offense from criminal sexual conduct and can be charged in addition to those statutes.
