§ 609.43 — Misconduct of Public Officer or Employee

Plain-Language Summary

It is a misdemeanor for a public officer or employee to intentionally fail to do their required duties, act beyond their authority, harm someone under color of authority, or file a false official report. The penalty is up to 364 days in jail, a fine up to $3,000, or both.

Practical Notes
This law holds government officials and employees accountable for misusing their positions. It covers both doing things they should not do and failing to do things they are required to do. The duty must be mandatory and clear, not something left to the official’s judgment. False official reports are also specifically covered.
