§ 609.561 — Arson in the First Degree

Plain-Language Summary

First-degree arson means intentionally setting fire to or blowing up a building, knowing people are inside or could be inside, or when the building is a dwelling. It is a felony punishable by up to 20 years in prison, a fine up to $35,000, or both.

Practical Notes
This is the most serious arson charge in Minnesota. It applies when there is a risk to human life. Setting fire to any occupied building or dwelling triggers this charge. The long prison sentence reflects the extreme danger of arson.
