§ 609.585 — Double Jeopardy
Plain-Language Summary
A person can be convicted and punished for both burglary and any crime committed during the burglary. The usual double jeopardy protections do not apply.
609.585 DOUBLE JEOPARDY.
Notwithstanding section 609.04, a prosecution for or conviction of the crime of burglary is not a bar to conviction of or punishment for any other crime committed on entering or while in the building entered.

Practical Notes
This means a burglar can face separate sentences for the burglary itself and for any theft, assault, or other crime committed inside the building. This is similar to the kidnapping double jeopardy exception.
