§ 609.71 — Riot

Plain-Language Summary

Riot means engaging in violent or threatening behavior with three or more people that disturbs the public peace. It is a gross misdemeanor. If a dangerous weapon is involved, it is a felony.

Rioting is more serious than unlawful assembly because it involves actual or threatened violence. The felony charge applies when any participant has a dangerous weapon. All participants can be charged, not just the most violent ones.
