§ 60B.04 — Jurisdiction and Venue

This section explains who can start insolvency proceedings against an insurance company and which courts handle them. Generally, only the Commissioner of Commerce can start these proceedings. However, if three or more unrelated judgment creditors have unpaid judgments against an insurer, they can also file a petition.

Practical Notes
If you have an unpaid judgment against an insurance company, you may be able to join with other judgment creditors to force liquidation proceedings. The court also has broad personal jurisdiction over agents, brokers, reinsurers, and officers of a failing insurer, even if they are outside Minnesota.
