§ 60B.53 — Liquidation of Property of Foreign or Alien Insurers Found in This State

Plain-Language Summary

This section allows the commissioner to ask the court for permission to liquidate the Minnesota assets of an out-of-state or foreign insurance company if no liquidator has been appointed in the insurer's home state. This protects Minnesota residents who have claims against the insurer.

Practical Notes
If a foreign insurer becomes insolvent and no home-state liquidation is underway, Minnesota can act independently to liquidate the insurer’s local assets. This can later convert to an ancillary proceeding if a home-state liquidator is appointed.
