§ 60B.11 — Commissioner's Summary Orders

Plain-Language Summary

The commissioner can issue orders to an insurance company to fix problems that could lead to insolvency. These orders can be issued after a hearing, or immediately in emergencies. If the insurer does not obey, it can be fined up to $10,000, and the commissioner can ask a court to enforce the order through an injunction.

Practical Notes
This gives the commissioner a quick tool to address emerging problems at an insurance company before full insolvency proceedings become necessary. Insurers can challenge these orders through the courts. The $10,000 penalty for noncompliance is collected by the attorney general.
