§ 60C.05 — Powers and Duties

Plain-Language Summary

This section lists what the guaranty association must do and what it is allowed to do. Required duties include paying covered claims, notifying claimants, and assessing member insurers. The association may also hire staff, borrow money, sue or be sued, and refund excess funds to member insurers.

Practical Notes
If your insurance company goes bankrupt, the association steps into the insurer’s shoes to handle your claim. The association can pick its own lawyers to defend covered claims. It pays claims from assessments collected from other insurance companies doing business in Minnesota.
