§ 611.46 — Incompetent to Stand Trial and Continuing Supervision or Monitoring

Plain-Language Summary

When a defendant is found incompetent, the court orders them to participate in a program to help them regain competency. The court must choose the least restrictive program that meets the defendant's needs and public safety. Options include community programs, jail-based programs, or alternative programs. The court must review the case if the defendant has not received services within 30 days. A forensic navigator monitors the defendant's compliance. The court examiner provides updated competency reports at least every six months.

Practical Notes
If you are found incompetent to stand trial, you will be placed in a program designed to help you regain competency. The court considers your needs and public safety when choosing a program. If you are in jail and do not receive services within 30 days, the court must review your case and may release you. A forensic navigator will help coordinate your services and monitor your progress.
