§ 62A.06 — Statements in Application

Plain-Language Summary

An insurer cannot hold you to statements made in your application unless a copy of the application is attached to the policy. Nobody except you can change your application without your written permission, and a false statement on your application can only be used against you if it actually affected the insurer's decision to cover you.

Practical Notes
If your insurer tries to deny a claim based on something you said in your application, ask whether the application was attached to your policy — if not, they may not be able to use it against you.
