§ 62D.07 — Evidence of Coverage; Required Terms

Plain-Language Summary

This section requires HMOs to give every enrollee an evidence of coverage document that clearly explains their benefits, exclusions, costs, and rights. The document must include an 'Enrollee Bill of Rights' on the cover page. HMOs must give 30 days notice of any changes to fees or benefits and allow a 31-day grace period for premium payments. Individual contracts can be canceled within 10 days for a full refund.

Practical Notes
Enrollees should carefully read their evidence of coverage document because it is the binding contract. The 10-day cancellation right gives individuals a cooling-off period after signing up. The Enrollee Bill of Rights guarantees access to emergency services, the right to refuse treatment, privacy of medical records, and the right to file complaints. Every document must include the Department of Health complaint phone number.
