§ 62D.095 — Enrollee Cost Sharing

Plain-Language Summary

This section sets rules about what HMOs can charge enrollees through co-payments, deductibles, and out-of-pocket maximums. Cost sharing must not discriminate based on age, sex, race, disability, or economic status. HMOs cannot charge co-payments or deductibles for preventive services. The rules must be consistent with the Affordable Care Act. These rules do not apply to Medical Assistance, MinnesotaCare, or Medicare programs.

Practical Notes
This section protects enrollees by ensuring that preventive care like checkups and screenings cannot be subject to co-payments or deductibles. Enrollees should know that any cost-sharing in their plan must follow these nondiscrimination rules. If you are on a public health program, different cost-sharing rules may apply.
