§ 62D.105 — Coverage of Current Spouse, Former Spouse, and Children

This section lets spouses, former spouses, and dependent children continue their HMO coverage when the main enrollee goes on Medicare or when children age out of dependent status. Continuation can last up to 36 months or until they get other coverage. The cost cannot exceed 102% of what the plan normally charges for similar coverage.

When a family member goes on Medicare, the remaining family members do not automatically lose their HMO coverage. This continuation right lasts up to 36 months and gives families time to find alternative coverage. Children who age out of dependent status also get this protection. The premium cap of 102% prevents HMOs from overcharging for continuation coverage.
