§ 62L.08 — Restrictions Relating to Premium Rates

Plain-Language Summary

This section limits how health insurance companies can set premium rates for small employers. Rates may vary based on age and geographic area, but gender-based rates are prohibited. Tobacco use may affect rates consistent with the Affordable Care Act. All rate variations must be actuarially justified and approved by the commissioner. Insurance companies must file their rates and demonstrate they are reasonable.

Practical Notes
If you are a small employer, your health insurance premiums can only vary based on employee ages, geographic area, tobacco use, and benefit design differences. Your insurer cannot charge you more because of the gender of your employees or their dependents. All rates must be filed with and approved by the state commissioner.
