§ 62L.22 — Assessments

Plain-Language Summary

This section gives the Reinsurance Association's board the power to assess member health carriers to fund the association's operations. If reinsurance premiums do not cover expenses, participating carriers are assessed based on their share of total small employer premiums, up to 4% of their small group market premium. Non-participating carriers can be assessed up to 1% in additional assessments. The board can also abate assessments for carriers in financial trouble and must refund excess funds to members.

Practical Notes
Health carriers in the small employer market may be assessed to cover the Reinsurance Association’s losses. The maximum assessment is capped at 4% of a carrier’s small group premium for participating carriers and 1% for non-participating carriers. Carriers can appeal assessments to the commissioner within 30 days of notice.
