§ 62R.03 — Applicability of Other Laws

This section explains which other laws apply to health care cooperatives. Health care cooperatives follow the general cooperative law (chapter 308A) but must also get licensed under one of Minnesota's health plan chapters. If this chapter conflicts with other laws, this chapter wins.

Practical Notes
A health care cooperative must be both a cooperative under Minnesota law and a licensed health plan. Provider cooperatives are not treated as insurance companies or HMOs and cannot be blocked from practicing medicine as a group.
