§ 65A.35 — Administration

Plain-Language Summary

This section establishes the governance and administration of the Minnesota FAIR plan. Every property insurer licensed in Minnesota must participate as a condition of doing business in the state. The plan is governed by a nine-member board with five elected industry directors and four public directors appointed by the commissioner. The plan of operation and all major decisions are subject to commissioner approval.

Practical Notes
The FAIR plan is an industry-run program with significant government oversight. Every insurance company that sells property insurance in Minnesota is required to financially support the FAIR plan. Public directors on the board give consumers representation in how the plan is run. The commissioner of commerce has final approval authority over the plan’s operations, rates, and underwriting standards.
