§ 70A.21 — Penalties

Plain-Language Summary

This section sets penalties for violating this chapter. The commissioner can fine up to $50 per violation, or up to $500 for willful violations. The commissioner can also suspend the license of any insurer or rate service organization that does not follow orders. No penalty can be imposed without a written order after a hearing with at least ten days' notice.

Practical Notes
The penalty amounts are relatively low, but the power to suspend a license is a serious enforcement tool. Due process is protected because no penalty can be imposed without a hearing and written notice. License suspension takes effect only after all appeal deadlines have passed or appeals are resolved.
