§ 79.34 — Creation of Reinsurance Association

Plain-Language Summary

This section creates the Workers' Compensation Reinsurance Association, which all workers' compensation insurers and self-insurers in Minnesota must join. The association covers 100% of losses above a member's chosen retention limit (starting at $500,000). Members can choose a low, high, super, or jumbo retention limit. The association is not a state agency and is exempt from taxation.

Practical Notes
Every workers’ compensation insurer and self-insurer in Minnesota must be a member of the Reinsurance Association. The association protects members from catastrophic losses by covering claims above the chosen retention limit. Members who choose higher retention limits cannot secretly transfer the risk below that limit to others. Violations can result in penalties of up to twice the premium difference.
