§
Subdivision 1.Permit for placing navigation hazards.
The commissioner may require that a permit is obtained for the placement of a structure or device determined by the commissioner to constitute a hazard to navigation. §
Subd. 2.Removing and damaging buoys prohibited.
Except as authorized by the commissioner, a person may not obstruct, remove, damage, or destroy a buoy or structure placed in the waters of this state in accordance with this chapter or by authority of the United States. §
Subd. 3.Uniform marking required for buoys.
A person may not place buoys or other waterway markers unless the markers conform with the uniform marking system established by the commissioner. §
Subd. 4.No duty to mark all hazards.
The marking of certain hazards to navigation on, in, or adjacent to the waters of this state by a governmental agency does not incur a duty to mark all navigational hazards by the agency or another agency.
